1. Scope of application

The business relationship between Gamer Tech Deutschland GmbH (hereinafter Gamer Tech) and its customers is governed by the following General Terms and Conditions (hereinafter GTCs).

We process orders and registrations in accordance with the GTCs valid at the time of the order or registration.

The current version of the GTCs is available on our website under the heading GTCs.

2. Conclusion of contract

You can book play visits via our website or register on site to take part in play visits.

The offers on our website are non-binding. By booking a desired play visit, you submit a binding offer to conclude a contract. As soon as we receive your offer, we will send you a confirmation email to the email address you have provided with an access code to start the play visit. With this email we confirm the acceptance of your contract offer and the contract is concluded.

Your order data will be stored by us after the conclusion of the contract for the execution of the contract.

We will provide you with appropriate, effective and accessible technical means by which you can recognize and correct input errors before submitting your order. Before submitting your order, we will show you a shopping cart in which you can view all the details of your order at a glance.

If you deliberately provide false data when ordering or registering, you will lose any entitlement to benefits.

The European Commission has set up a European online dispute resolution platform for the alternative out-of-court settlement of disputes between consumers and companies regarding purchase and service contracts concluded on the internet, which can be accessed here: http://ec.europa.eu/consumers/odr/. However, we do not participate in dispute resolution proceedings before this consumer arbitration board.

3. Delivery

Access codes and tickets are only sent by email.

4. Payment procedure

The purchase price is due immediately upon ordering.

Credit card and Paypal payments are processed by our partners Mollie B.V. and Stripe Inc. You will be redirected accordingly.

Gamer Tech has the right to block the access code to the start until all payment claims arising from the contractual relationship have been settled in full.

5. Performance

The access code entitles you to use the games on the booked day of validity and within the booked scope of validity.

With your order you accept our house rules and rules of the game.

6. Photo and video recordings

By participating in the games, visitors give their consent for Gamer Tech to use security cameras to take photos and video recordings of visitors during their visit. The recordings will not be processed further, but will be used exclusively for security purposes and to control the visitor experience. Gamer Tech cannot and will not be liable for the use of this material.

7. Liability

Gamer Tech is liable in accordance with the statutory provisions for damages resulting from injury to body or health as well as for damages caused by intent or gross negligence.

Gamer Tech shall be liable for other damages resulting from a slightly negligent breach of material contractual obligations, limited to compensation for foreseeable damages typical of the contract.

Material contractual obligations are those whose breach jeopardizes the achievement of the purpose of the contract, whose fulfilment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies.

Gamer Tech accepts no liability for the visitor's wardrobe or other items in the event of loss or damage, unless the damage is due to an intentional or grossly negligent breach of duty by Gamer Tech, a legal representative or one of its vicarious agents.

Gamer Tech shall not be liable for force majeure and coincidence or for defects that are not recognized immediately even if the usual care is taken.

Visitors are liable for any damage caused by them or by persons under their supervision to the facility or objects belonging to the operator or third parties or to the health of third parties.

8. Rules

The use of all games involves risks. Some games involve intensive sporting activities and challenges. You should only take part in these games if your health permits. If you have health restrictions or are pregnant, consult your doctor first.

You use the games at your own risk! Know your limits and do not exceed them. Be at least as careful when playing as you are when playing sport. We are only liable for personal injury, damage to property or financial loss - except for damage resulting from injury to life, limb or health - in the event of intent or gross negligence on the part of the operator, a legal representative or one of their vicarious agents.

Please inform the staff immediately if you discover an accident or damage.

Treat other players responsibly and respectfully.

Food is prohibited on the play equipment.

Playing under the influence of excessive alcohol or drugs is prohibited.

By concluding a contract, you agree to the validity of and compliance with these rules. They serve the safety of all players.

9. Revocation / Revocation instruction

Every consumer is entitled to the right of withdrawal. A consumer is any natural person who concludes a legal transaction for private purposes and not in the exercise of their commercial or independent professional activity.

You have a statutory right of withdrawal for contracts for voucher tickets. This means that you have the right to cancel the contract within fourteen days of purchasing a voucher without giving any reason.

To exercise your right of withdrawal, you must inform Gamer Tech of your decision to withdraw from this contract by an unequivocal statement sent to the email address service@gamer.jetzt. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will we charge you any fees for this repayment.

Contracts for the purchase of admission in connection with leisure activities for which a specific date or period is provided are not subject to the right of withdrawal. This means that there is no two-week right of withdrawal and return (Section 312g (2) No. 9 BGB).

10. other

German law shall apply to all disputes arising from or on the basis of this agreement.

In the case of contracts for a purpose that cannot be attributed to the professional or commercial activity of the beneficiary (contract with consumers), this choice of law only applies insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the country in which the consumer has his habitual residence.
